"Agreement" means these terms and conditions of use as may be amended from time to time.

"Eumom.com" means Eumom Limited of 101 Monkstown Rd., Dun Laoghaire, Co. Dublin, Ireland with registered no. 318793.

"Content" means the information content on this site for the purpose of providing general educational information only. 2. User obligations

Contains pirated software or constitutes an act of software piracy;

Enables any hacking

2.2 The User is, and at all times shall be, an end user of the Service, and the User shall not resell or sub-licence in exchange for payment the Service or information provided on the Site to any third party without the written permission of Eumom.com. The User is responsible for the actions of any person who avails of this Service or accesses the Site through the User's registration with Eumom.com.

2.3 The User will comply with all reasonable instructions given by Eumom.com from time to time in connection with the use of the Service.

3. User indemnity

The user shall indemnify Eumom.com, its promoters, contractors, servants, employees, advisors or agents, against any and all losses of whatsoever nature (including, but not limited to, direct and indirect loss, consequential loss, economic loss, loss of profits, loss of business, loss of contracts, loss of revenue, loss of anticipated savings, loss of goodwill or loss of reputation), liabilities, claims, damages, settlements, awards, costs, expenses and proceedings incurred by Eumom.com, its promoters, servant, employees and/or agents in consequence of the user's use or misuse of this site or the information or the resources contained on or accessible through this site or infringement of intellectual property rights, and/or by reason of any breach of these terms and conditions of use and/or due to the act, error, omission, default or negligence of the User or of any third party who has access to this site via the User's connection or otherwise howsoever arising.

4. Eumom.com's obligations

4.1 All information, services, products, materials and other resources that are made available on the Site are provided "as is" and "as available" without any representation or warranty of any kind. All implied conditions, terms and warranties that may arise under statute, custom, usage, in equity, tort, at common law or otherwise are hereby expressly excluded to the fullest extent permitted by law. The User confirms that this is fair and reasonable.

4.2 Eumom.com does not warrant that the supply of this Service shall be without interruption or deterioration or that reconnection can be achieved within any specific time or period or that any network through which internet connection is achieved will at any time in the future be accessible and compatible with this Service, or will continue to operate as it does currently.

4.3 Eumom.com has no editorial relationship with any websites, links to which are featured on the Site ("link sites"). Accordingly Eumom.com makes no warranties, representations or guarantees about them, or any products, content or services which may be provided through any link sites. Eumom.com shall not be liable to the User or any third party for any losses of whatsoever nature (including, but not limited to, direct and indirect loss, consequential loss, economic loss, loss of data, loss of profits, loss of business, business interruption, loss of contracts, loss of revenue, loss of anticipated savings, loss of goodwill or loss of reputation), whether based on breach of contract, tort (including negligence), product liability, statute, equity or common law, or howsoever otherwise arising out of or in any way connected with the use, performance or contents of this site or any other site. Eumom.com disclaims all responsibility and liability of any description, including without limitation, liability for negligence, incidental or consequential damages and/or loss suffered by any person acting or refraining from action as a result of or in connection with this site, to include any reliance placed by such person on such material, or the viewing or use or performance of this site.

Eumom.com assumes no responsibility for computer systems, hardware, software or programme malfunctions or for other errors, failures or delays in computer transmissions or network connections that are human or technical in nature, or for lost, late, or otherwise damaged or misdirected information. Eumom.com, reserves the right, in its sole discretion, to cancel or suspend this programme at any time without notice should a virus, bug or other causes beyond Eumom's control corrupt the administration, security or proper function of this programme.

Eumom.com shall have no responsibility or liability to the User for any errors or interruptions in (or any delay in reinstatement of) the Service, whether arising out of a failure of any telecommunications lines, operated by any telecommunications operator, or hardware/software service interface, other connection points of any other network providers equipment or services or of any other network.

6. Commencement, term and termination

6.1 Eumom.com may disconnect this Service at any time without notice to the User if:

The User is in breach of any terms of this Agreement;
The User is suspected of an involvement with fraud or acts which are of a defamatory, offensive, abusive, obscene, menacing, unsuitable or unlawful character in connection with the use of the Service; or
Eumom.com is required by the order of any court or regulatory authority to discontinue the provision of this Service, or is deemed necessary by Eumom.com to disconnect the Service in order to prevent the commission of any offence or the continuance of any unlawful activity.

7. Intellectual property

The User confirms and acknowledges that all copyright, trade marks (registered or unregistered) and other intellectual property rights of whatsoever nature arising from the Content, including the Site's design, layout and organisation, are owned by, or licensed to, Eumom.com. Except as stated herein no part of the Content may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form by any means, including but not limited to, electronic, mechanical, photocopying, recording or otherwise without the prior written permission of Eumom.com. Permission is granted to access, download, or print such material for your personal, non-commercial use only and subject to these terms & conditions.

8. Amendment

Eumom.com reserves the right to amend this Agreement at any time. Any such amendments will be valid immediately once they are posted on the Site. This Agreement cannot be otherwise altered without prior consultation with Eumom.com.

9. No waiver

Failure to act with respect to any breach of any rule whatsoever by the User shall in no way affect Eumom.com's future right to act with respect to future similar breaches.

10. Severability

In the event that any provisions of this Agreement are held to be unenforceable, illegal or void in whole or in part, the remaining portions of the Agreement shall remain in full force and effect.

11. Force majeure

Neither party shall be liable for any breach of this Agreement due to any cause beyond its reasonable control, including, but not limited to, a failure of any telecommunications lines, operated by any telecommunications operator, or hardware/software service interface, other connection points of any other network provider's equipment or services or of any other network.

12. Governing law

This Agreement and the resolution of any dispute related to this Agreement or this Site shall be governed by and construed in accordance with the Laws of England and Wales, and the parties hereby submit to the exclusive jurisdiction of the English courts for all matters arising in connection with or in any way related to this Agreement.

13. Notices

Written notice under this Agreement is satisfied once the sender receives confirmation of delivery of an electronic message sent to the other party.

Notices to be sent to Eumom.com should be sent to info@eumom.com.

Notices to be sent to the User will be sent to the e-mail address specified by the User on registration with the Site.

14. Data protection

Eumom.com will comply with its obligations under the Data Protection Act, 1998 and any other data privacy-applicable legislation. Any information about the User obtained by Eumom.com will be used in accordance with Eumom.com's Privacy Policy statement.
